8.3.8 Trademark clearance search for the Motir brand mark (classes 9 + 42)

Type: manual · Executor: human · Run a registered-trademark clearance search for the chosen brand mark before launch.

⚠️ Corrected 2026-08-19 — this card described the WRONG MARK, and its subject is about to move again. Two amendments, from the re-plan of MOTIR-1343:

  1. The mark is the WAVE BAND, not the lattice. This body described "A · Lattice (two concentric rhombi + four vertex nodes)" and a prior-art check against Binance / Renault / Umbro / Mitsubishi. That candidate was superseded: Yue approved the wave band on 2026-08-06 (MOTIR-1140), and design/brand/design-notes.md §1 records it as the final mark — "an earlier revision built it from the letter M; that was rejected", and the rhombus candidate with it. A clearance search run from the old body would have searched a device Motir does not use. The approval swept the design asset and not this card.
  2. The artwork is being RE-DRAWN, so the figurative half of this search has no final subject yet. The band is closed by translating the upper curve straight down rather than offsetting it along its normal, which pinches it to ~41 % of its crest weight and collapses one end into a needle; the re-draw fixes the construction under the story above. The CONCEPT is unchanged — a two-curve band — so the search's classes, registries and word-mark half are unaffected; the figurative comparison is not. Run this card against the FINAL committed design/brand/wave-band.svg and record which revision (its commit sha) was searched, so a later re-draw can be told apart from an unsearched one.

MOTIR-1139 performed a visual-similarity check against public sources only, recorded in design/brand/design-notes.md §1 "Prior art". A visual check is not clearance. This card is the real search: registered and pending marks in the classes Motir actually trades in.

Needs a human — it is a legal/registry task using paid databases and, most likely, trademark counsel. A coding agent cannot do it.

Acceptance criteria

  • Search performed in class 9 (software) and class 42 (SaaS / software services), at minimum for: EUIPO (moooon B.V. is a Dutch entity), UKIPO, and USPTO.
  • Both the figurative mark and the word mark "Motir" are searched — the word mark is a separate exposure this card also closes.
  • The figurative search is run against the wave band as committed at the time of the search, with the Vienna classification chosen for a two-curve band device (NOT the rhombus/geometric classes the superseded lattice candidate would have used), and the searched revision's commit sha recorded in the result.
  • The result is checked against the closest visual neighbours the FINAL artwork actually has — established from the searched revision, not inherited from §1's rhombus-era table.
  • Result recorded as a comment on this card and, if it changes anything, as an update to design/brand/design-notes.md §1.
  • If a conflict is found: log a bug linked to MOTIR-1139 and re-open the glyph decision rather than shipping around it.

Ordering

Does not block MOTIR-1150 — the mark can ship internally and on pre-launch surfaces while this runs. It must complete before public launch (Epic 8), so it belongs ahead of MOTIR-1130 (take Motir's project public).

No blocked_by edge to the re-draw is wired, and that is deliberate: the re-draw is a subtask under MOTIR-1343 in another epic, and a blocked_by joins siblings under one parent. Sequencing is carried by the criterion above — search the committed artwork and record its sha — which is enforceable by whoever runs this card, where an illegal cross-parent edge would not be.
